>>GENEVA - An American attorney best known for his efforts to win compensation from Swiss banks for Holocaust victims is set to tackle the financiers again on behalf of people who suffered under South Africa's apartheid-era regime.
>>
>>Ed Fagan is expected to file a class action lawsuit in a Manhattan court seeking 80 billion Swiss francs (dlrs 51 billion) from the banking giants UBS and Credit Suisse citing their assistance to South African authorities from 1985 to 1993, when the country was under a United Nations ( news - web sites) embargo, the SonntagsZeitung newspaper reported. The banks helped the white-dominated regime, which was struggling as foreign capital fled the country, with loans and other business deals worth billions of francs (dollars).
>>Fagan represented Holocaust victims and their heirs who forced Swiss banks into a dlrs 1.25 billion settlement in 1998. The plaintiffs alleged the banks had made it almost impossible for recover money deposited for safekeeping as the Nazis swept across Europe, demanding lost documents to prove ownership and even death certificates of people killed in Nazi concentration camps.
>>In an interview with the SonntagsZeitung, a South African lawyer who is working with Fagan said the banks"should be financially answerable for the suffering they caused the black population."
>>"The regime would never have survived so long if it had not been propped up after 1985 by firms whose only motive was profit," said Dumisa Ntsebeza."Now they should do something to help build the country and aid the victims of apartheid."
>>South Africa's white minority controlled the country from 1948 until 1994.
>>"South Africa is now a democratic country and every citizen has the right to turn to the courts," Ntsebeza said. A telephone hot line for victims who wanted to join the case would be opened in South Africa Monday, he said.
>>Thomas Pletscher, a board member of Switzerland's main financial industry group, Economiesuisse, told The Associated Press Sunday that he was unaware of the case. He refused to comment on SonntagsZeitung reports that the group had discussed the banks' past links with South Africa at a meeting last month.
>>Credit Suisse spokeswoman Karin Rhomberg said the bank saw"no grounds" for the lawsuit.
>>"We are against all forms of racism, but it's absurd that our group should be held jointly responsible for the wrongs of the apartheid system," she said."There is no factual evidence to back this."
>>UBS spokesman Michael Willi said he knew nothing of the case and declined to comment.
>>Neutral Switzerland never joined U.N. sanctions against the apartheid regime and has faced other criticism over its ties with South Africa.
>>Last year Swiss authorities said they were reopening an investigation into links between the country's intelligence service and apartheid-era South Africa after reports that the Alpine nation's former spy chief helped the racist government in its plans to develop chemical and biological weapons for use against blacks.
>>An earlier inquiry in 1999 cleared the Swiss intelligence service and its chief Peter Regli — who is now retired — of colluding with the former head of South Africa's chemical and biological warfare program, Woutter Basson. But during a trial last year Basson claimed he had enjoyed good contact with the Swiss and particularly with Regli.

Gruss
Pancho
