Judge throws out suit against Merrill Lynch mutual fund

NEW YORK (AP) -- A federal judge on Wednesday threw out a lawsuit by investors who lost money in a Merrill Lynch technology-stock mutual fund and claimed the firm issued misleading research reports to win investment banking business.
The class-action lawsuit covered investors who put money into Merrill's Global Technology Fund between October 1999 and October 2002 -- a period marked by dramatic decline in technology stock prices.
The investors claimed Merrill intentionally put out misleading reports on stocks covered by the fund to win investment banking business from those companies -- without any regard to whether they were sound investments.
But U.S. District Judge Milton Pollack ruled that it was public knowledge that the fund included stocks covered by the Merrill Lynch analysts' reports.
"The alleged conflict of interest between brokerage firms, investment bankers and research analysts... was a matter of public knowledge for years before the amazing boom of the market initially rewarded those who disregarded such caveats," the judge wrote.
Earlier this week, the same judge tossed out lawsuits by investors who said Merrill was responsible for the money they lost on two companies whose stock prices plummeted after the Internet bubble burst.
