I took up your enquiry with a senior partner at a well known Paarl lawfirm who commented as follows:

(a) The relevant Minister merely said that the South African Government should possibly appoint a commission of enquiry to determine how many properties are currently owned by foreign investors.

(b) In view of the outcome of the abovementioned exercise, if necessary, to then put specific measures in place to try and limit foreign ownership of property in South Africa.

(c) The whole exercise is actually aimed at controlling the ownership of agricultural land. At this stage residential land ownership is irrelevant.

(d) Should the South African Government however decide to take any action or implement any legislation that such action or legislation will not be retrospective. In other words if you buy a property now it will not be affected should any future legislation regarding the matter concerned be implemented.
